The terms and conditions set out in this document are the current terms and conditions which will apply to every person using the West Coast Cocoa website. West Coast Cocoa can vary or update these terms and conditions at any time. Replacement terms and conditions will be posted on the West Coast Cocoa website and will be deemed to come into force as soon as they are posted. Nothing in these terms and conditions limits your rights under the Consumer Guarantees Act 1993 where you are a consumer for the purposes of the Act.
You may sign up as a user of the West Coast Cocoa website using the form contained on this website. You may only sign up once. You must not take any steps to circumvent or avoid the proper operation of the facilities.
All use of the facilities must be made honestly and in good faith. All users acknowledge and accept that we can not guarantee that the provision of the facilities will be completely uninterrupted, or free from mistake. Unless specifically stated all currencies used on this site shall be deemed to be in New Zealand dollars and inclusive of GST.
You may only buy once you have become a registered user of West Coast Cocoa website. An order is deemed to be a “Standing Order” once buyer has taken delivery of second order, not on the delivery of first order. West Coast Cocoa accepts credit card orders from most major credit cards and our transactions are processed through DPS using a secure encrypted server. Customer credit card information is not stored on our server. The name on your statement will be West Coast Cocoa.
If goods are returned due to being faulty, so long as they are returned within a reasonable time the remedy afforded to the customer, under the Consumer Guarantees Act 1993, is a replacement or refund. Where a consumer exercises his/her cancellation rights, the customer will be given a replacement or refund within 30 days of their cancellation. The cancellation period ends on the expiry of seven working days, commencing on the day following the day on which you, the customer, receives the goods. Custom orders are excluded from these terms. If you, the customer, choose to cancel your order without given a reason, you can be asked to return and pay for the cost of returning the goods.
We ship all orders through CourierPost and freight is charged at a flat rate of $5.00 (excluding GST) per order. Delivery is usually 1–2 business days from the date of shipping. If your shipment is sent as urgent or priority shipping, additional charges will apply and you will need to contact us prior to placing your order to discuss pricing. Product will only be delivered to New Zealand addresses.
We are committed to upholding our obligations under the Privacy Act 1993. This clause sets out our views on the use of your personal information and our obligations in relation to such information. We will not sell any personal information held about you to third parties. We may send you emails from time to time and you may request to be removed from any such mailing list at any time. We will provide you with the means to alter and update your personal information at any time and it is your responsibility to ensure that such information is kept up to date and accurate. It is your responsibility to maintain the security of your password and to take steps to disable your account or update your password immediately upon becoming aware of any likely breach of security. You will remain liable for all use being made of your account whether authorised by you or not. We may from time to time employ various security measures of our choice to protect any information being transmitted to or via the facilities. Any security measures in place will be readily identifiable from the facilities from time to time. In transmitting information you are deemed to have approved and accepted such security measures (if any) as are then in use on the facilities and no subsequent complaint will be considered about such security measures or the lack thereof.
We are confident that our website will provide a high quality of service. However, we can not and do not guarantee the availability of the facilities at any given time or for any given duration. These terms and conditions are governed by the laws of New Zealand. All copyright and intellectual property rights of any description arising in the development and creation of West Coast Cocoa website, its facilities, its brands, text, software and in any other sense whatsoever will remain owned by West Coast Cocoa. You may not without our prior express written agreement do anything to infringe upon those rights. You must not use any part of the materials on our site for commercial purposes without first obtaining a licence with written permission to do so from us or our licensors.
You understand that all Content posted by Users/Authors, whether publicly posted or privately transmitted, are the sole responsibility of the User from which such content originated.
